In its recent resolution on the situation in Belarus, PACE called upon the Belarusian authorities to allow registration to the Nasha Viasna human rights organization, which is one of the essential conditions for the country to meet the Council of Europe standards.
According to Ales Bialiatski, the requirement is an additional stimulus for Viana’s members to continue their activities.
‘PACE’s concern over the situation regarding freedom of association in Belarus is a crucial point. It is another evidence of the high human rights standards in the Council of Europe. If the Belarusian authorities are thinking about restoring and improving Belarus’ status in the CE, they have to fundamentally reform the situation regarding the registration of NGOs, since the situation in this field is far from being perfect. Any other CIS country, e.g. Armenia, has 10 times more registered NGOs per capita than Belarus. I think that these figures speak for themselves,’ said Mr.Bialiatski.

On 9 May in Navapolatsk several skinheads attacked girls, activists of the local branch of the BNF Youth (youth organization of the Belarusian Popular Front party).

In the evening two students were on their way home from the university though a forest-park. The unknown stopped them at a far corner, took away their badges with national symbols, threatening with bodily harm. The girls immediately called up police, but they didn’t arrive.

lgot1st_twAnton Yasinovich, together with other persons, was engaged in authorized picketing in Navapolatsk. The picket was aimed at expressing protest against the withdrawal of social preferences by the Belarusian Parliament, as well as conducting a written public inquiry on the decision. The results of the inquiry were sent to the President’s administration and local executive bodies.
However, Anton Yasinovich was accused of violating Article 130-137 of the Electoral Code of Belarus and fined BYR 1,085,000.
The court failed to prove that Yasinovich had breached public order, nor was he charged with undermining national security.
Considering the above-mentioned facts, we believe that the Republic of Belarus has violated his right to free reception and exchange of information, as well as the right to public dissemination of his personal opinion.
Anton Yasinovich has exhausted all the domestic judicial remedies and therefore lodged a complaint with the UN Human Rights Committee, yet to be considered by the authoritative body.

The memorial action was to take place at the execution and burial spots of the repressed people, in the villages of Paliai, Varony and Koptsi, Vitsebsk district. The activists were going to install a cross and lay flowers on the place of mass executions. However, they were approached by representatives of the police, with Deputy Chair of Vitsebsk District Police Department Major Lilenka at its head, who named the funeral procession an unauthorized picket and suggested stopping it. Barys Khamaida was detained on 7 July 2007 (birthday of the People’s Poet of Belarus Yanka Kupala) in downtown Vitsebsk as he was holding a poster with the poet’s verse written on it. He was taken to Vitsebsk Chyhunachny Police Department and charged with violating Article 23.34 of the Civil Code (violating procedures of holding mass actions and pickets). On the same day, Mr.Khamaida’s case was considered by Judge Bardziukova of Vitsebsk Chyhunachny Court. As a result of the trial, the activist was fined BYR 310,000. Continue reading »

luter-rose_c-1The Commissioner on Religions and Nationalities of the Council of Ministers of the Republic of Belarus (registration authority) issued a written warning # 02-03/720 to the Religious Association Evangelical-Lutheran Church in the Republic of Belarus for violating the Law on Freedom of Conscience and Religious Organizations.
At the same time, the decision by the Commissioner resulted in unfavourable legal consequences for our religious association. Under paragraph 2 Article 37 of the Law on Freedom of Conscience and Religious Organizations, in case the violations are not corrected or occur again within a year, the registration authority has a right to initiate the organization’s judicial dissolution. Yes, on 9 October 2009 parents of Yanka Lapitsky (a Belarusian-speaking student of Gymnasium № 1 in Zhodzina) received another response to theirs appeal, which was sent DIRECTLY to the Minister of Education of Belarus, Mr. Radzkou.

Surprisingly, the Deputy Minister, Mr. Faryna, whose inactivity was highlighted in the appeal, responded to this parents’ address to the Minister by himself (!?). Answer from the Ministry of Education of 06.10.2009 under No. 06-1156-K-(1)-0 was signed by this official. Continue reading »

On 25 March Maryiana Hruzdzilovich was suddenly dismissed from the position of a teacher at a branch of the British educational center SOL Minsk. The reason was a fabricated letter, allegedly sent by a group of parents, in which it was stated that the teacher was dealing with oppositional propaganda among pupils. By the way, it was impossible to collect parents’ signatures under the letter, as the classes, at which the teacher reacted to a disgraceful saying of a pupil about participants of 25 March action, ended at 9 p.m., and the following morning the administration of the educational center received the letter concerning this incident. Maryiana also made telephone calls to the parents to ensure that they had received no telephone calls and there were no talks about complaining against her. Only later did the teacher found, that the father of the ‘insulted’ pupil was a police colonel.

Former Tomsk mayor Alexander Makarov, who was re-elected for a third term in 2004, was arrested by Russian police on December 8, 2006, and later charged with possession of narcotics and abuse of office.

The town authorities also refused to assist the Young Front in finding premises for holding a constituent assembly by the organization’s local office. At the same time the founders of the movement were warned that holding an illegal congress would be viewed as violation of the Law on Mass Actions and may result in administrative or criminal prosecution.

On 20-21 February Minsk hosted a regular session of the International Student Human Rights School/Students’ Rights, organized by the Studentskaya rada initiative, Youth Human Rights Movement and the Youth Network for Students Rights, and visited by 25 teenagers from Belarus, Ukraine and Russia.

The seminar was conducted by a CE expert Andrei Yurov, along with Dmitry Makarov, coordinator of the Youth Network for Students Rights.

According to www.interfax.by, the situation in the village of Pukhavichy (Homel region), famous for its notorious case of ‘the arsonist of Pukhavichy’, is getting tense, since some of the villagers are not pleased with murderers having been set free.

Three residents of the village were prosecuted for the murder of their fellow villager, thought to have been guilty of numerous arsons. Shortly after the suspects were put to prison, President Lukashenka publicly urged the police to release the murderers due to ‘the insignificance of the crime.’

Homel Thsentralny Borough Court sentenced Kastus Zhukouski to 7 days of arrest for participating in a Mother Language Day action in downtown Homel. Vasil Takarenka, Marysia Tulzankova and Ales Viartseika were fined BYR 700,000 each. The teenagers were standing in the center of Homel holding posters with the words ‘Mother Tongue’ and a Russian phrase ‘Banned’ across. Their mouths were covered with green and red ribbons.
NB: International Mother Language Day, celebrated annually on February 21, aims to promote the recognition and practice of the world’s mother tongues, particularly minority ones.

On 7 February there took place the constituent assembly of the Assembly of Democratic NGOs, at which the organization charter and other documents necessary for state registration were adopted. 

Among the founders of the assembly there are NGOs from all over Belarus, including the Republican human rights association Belarusian Helsinki Committee, the Center for Human Rights, Minsk NGO ‘Center Supolnasc, the public association of large families of Verkhniadzvinski district Family, etc. If the Assembly of Democratic NGOs passes the state registration successfully, other NGOs will be invited to join it as well.

On 7 February Zmitser Khvedaruk, member of the Young Front unregistered youth organization, officially joined the army in military unit #18662 in Zhodzina. The activist was drafted to the army despite the fact he is a full-time student of the Christian College. He had also been previously prosecuted for membership in an unregistered organization – Article 193-1 of the Belarusian Criminal Code. Thus the state showed that it is the authorities not the Constitution that rules in the country.

Vitsebsk authorities have banned a picket in commemoration of an iconic Soviet actor and singer-songwriter Vladimir Vysotski, for which a representative of the Belarusian Helsinki Committee of Vitsebsk region Pavel Lyavinau applied.
