On 19 January, deputy chair of the Human Rights Center “Viasna” Valiantsin Stefanovich lodged a complaint with Minsk City Court demanding to reverse an earlier decision of 16 December 2011 by Minsk Partyzanski District Court to exact 56 mln. rubles of fine for alleged tax violations.

The municipality of the Italian city of Genoa granted the status of honorary citizen to Ales Bialiatski, Chairperson of the Human Rights Center Viasna. The Italian society expressed thereby its concern with the situation of human rights in Belarus, particularly the use of the death penalty, restriction of the freedom of the media and civil and political rights. The Ministry of Foreign Affairs answered the address of human rights defenders concerning the registration of the death convict Vasil Yuzepchuk’s communication by the UN Human Rights Committee.
‘We inform you that the official note of the Office of the UN High Commissioner for Human Rights concerning the registration of the individual communication on behalf of Yuzepchuk V.L. has been submitted to the competent state organs,’ is stated in the MFA answer, signed by the deputy minister S.Aleinik. The Human Rights Center Viasna collected information about the facts of tortures and inhuman treatment of the detained participants of the peaceful actions held on 9 and 16 September 2009. The lawyers also prepared 6 complaints to the Tsentralny district prosecutor’s office of Minsk against the unlawful police actions and questioned some eyewitnesses of the tortures.
On 12 October the compiled materials were directed to the International Federation of Human Rights and will be passed to the OMCT (World Organization against Torture) and the UN Committee against Torture with the assistance of the FIDH representative in Geneva to get an appropriate international reaction. On 6 October the head of the Human Rights Center Viasna Ales Bialiatski and the lawyer Uladzimir Labkovich attended the trial, held on the lawsuit of the president of the Chechen Republic Ahmat Kadyrau for protection of his honor and dignity from the Russian human rights organization Memorial. In its recent resolution on the situation in Belarus, PACE called upon the Belarusian authorities to allow registration to the Nasha Viasna human rights organization, which is one of the essential conditions for the country to meet the Council of Europe standards.
According to Ales Bialiatski, the requirement is an additional stimulus for Viana’s members to continue their activities.
‘PACE’s concern over the situation regarding freedom of association in Belarus is a crucial point. It is another evidence of the high human rights standards in the Council of Europe. If the Belarusian authorities are thinking about restoring and improving Belarus’ status in the CE, they have to fundamentally reform the situation regarding the registration of NGOs, since the situation in this field is far from being perfect. Any other CIS country, e.g. Armenia, has 10 times more registered NGOs per capita than Belarus. I think that these figures speak for themselves,’ said Mr.Bialiatski.

The judge of Vitsebsk oblast court Halina Urbanovich announced a break after the petition of the defendant Leanid Svetsik for cessation of legal persecution and dropping the criminal case against him. The human rights defender said that he could not understand what he was accused in and considered himself innocent.

Front Line is concerned by the decision of the Supreme Court of the Republic of Belarus, on 22 April 2009, to maintain the previous decision of the Ministry of Justice not to register the human rights organisation Nasha Viasna (Our spring). Nasha Viasna is the new name of the human rights centre previously known as Viasna (Spring), which was closed down by the Supreme Court following the demand of the Ministry of Justice on 28 November 2003. The human rights center Viasna is one of the most active Belarusian human rights organisations, specialising in particular in the defence, protection and promotion of political and social rights.

Today on 27 March the co-founders of the Nasha Viasna human rights organization received a letter from the Supreme Court of Belarus saying that the complaint against the unlawful refusal to register the NGO was received for consideration by the court. The session is due to start on 7 April.

The issue under analysis is still topical, having a definitely practical meaning in the light of the recent events and the post-election resolution by the Council of Europe. The article deals with the issues having an enormous practical significance for the democratization of the society.
Their solution could be a step towards the international community, aimed at the creation of a renewed reputation of Belarus as a sensible and predictable partner, committed to the international standards in the field of civil and political rights, the International Covenant on Civil and Political Rights, in particular.
Thus, to be or not to be: that is the question!
