The European Court of Human Rights in Strasbourg has ordered Russia to pay 8,000 euros ($10,200) in compensation to a former Siberian mayor who has been in jail since December 2006, the court said on Thursday.

Former Tomsk mayor Alexander Makarov, who was re-elected for a third term in 2004, was arrested by Russian police on December 8, 2006, and later charged with possession of narcotics and abuse of office.

The town authorities also refused to assist the Young Front in finding premises for holding a constituent assembly by the organization’s local office. At the same time the founders of the movement were warned that holding an illegal congress would be viewed as violation of the Law on Mass Actions and may result in administrative or criminal prosecution.

According to www.interfax.by, the situation in the village of Pukhavichy (Homel region), famous for its notorious case of ‘the arsonist of Pukhavichy’, is getting tense, since some of the villagers are not pleased with murderers having been set free.

Three residents of the village were prosecuted for the murder of their fellow villager, thought to have been guilty of numerous arsons. Shortly after the suspects were put to prison, President Lukashenka publicly urged the police to release the murderers due to ‘the insignificance of the crime.’

On 7 February there took place the constituent assembly of the Assembly of Democratic NGOs, at which the organization charter and other documents necessary for state registration were adopted. 

Among the founders of the assembly there are NGOs from all over Belarus, including the Republican human rights association Belarusian Helsinki Committee, the Center for Human Rights, Minsk NGO ‘Center Supolnasc, the public association of large families of Verkhniadzvinski district Family, etc. If the Assembly of Democratic NGOs passes the state registration successfully, other NGOs will be invited to join it as well.

On 7 February Zmitser Khvedaruk, member of the Young Front unregistered youth organization, officially joined the army in military unit #18662 in Zhodzina. The activist was drafted to the army despite the fact he is a full-time student of the Christian College. He had also been previously prosecuted for membership in an unregistered organization – Article 193-1 of the Belarusian Criminal Code. Thus the state showed that it is the authorities not the Constitution that rules in the country.

Markelov was member of the Interrepublican Bar and founder of the Institute of the Supremacy of Law. Human rights defenders and civil society activists distributed the Universal Declaration of Human Rights in the streets, at the procuracy, at the executive committee, at the youth center, at a number of secondary schools, at the check-point of the Belarusian Automobile Plant. In some cases other informational materials were distributed as well. Уладзімер Кацора (Гомель)Uladzimir Katsora, Homel activist of the democratic forces, has received answers from the Ministry of Foreign Affairs, the Ministry of Justice and the Constitutional Court of Belarus to his inquiry concerning the restoration of the legal status of the NGO ‘Civil Initiatives’.

Mr. Katsora directed his appeal to the abovementioned state organs in October 2008. ‘Civil Initiatives’ was liquidated by Homel oblast court in 2003. Three years later the UN Human Rights Committee confessed that the organization was liquidated unlawfully, with violation of the freedom of association, and therefore was to be restored. The plaintiffs intended to hold these pickets in September, during the agitation state of the election to the parliament. “We observe unprecedented processes when the regional Committee for State Security (KGB) appeals to court under the Code of Civic Procedures, asking to recognize the legal fact that some printed editions are extremist. Among the editions on their list there is the Chronicle Review of Human Rights Violations in Belarus”, published by Viasna in 2004. According to the plaintiffs, it contains pictures from the rallies of anti-Belarusian nature: the Freedom Day, the Chernobyl March, Ancestors’ day, and others.
