Chairman of the NGO “Pakt” Mikhal Pastukhou

Public human rights association “pact” was trying to get official status in Belarus, but was refused.

After the exhaustion of domestic remedies founders complained to the UN Committee on Human Rights. Now Belarusian officials will have to find an answer to the question why the citizens can’t join into the associations to defend their rights without any control of the authorities.

The appeal of republican human rights association “Pakt” (Movement for the implementation of the International Covenant on Civil and Political Rights) to the UN was filed on behalf of the Chairman of the Association, Doctor of Law, Professor Mikhail Pastukhou, deputy – Uladzimir Bukshtynau and executive director, human rights defender Leanid Sudalenka.

The complaint alleges Belarus violating the right to freedom of association and calls attention to the fact that Belarus is not complying with its international obligations in this field. The complaint also states that acting on behalf of unregistered associations in Belarus is considered an offense and is punishable under criminal law.
– We do not agree with the Ministry of Justice, Supreme Court and Attorney General’s Office, which considered the question of the registration of our association – technical mistakes cannot be a sufficient reason for refusing registration of our initiative. We certainly declare the violation of Article 22 of International Covenant on Civil and Political Rights, – said the executive director of the NGO “Pakt” Leanid Sudalenka.

Let’s remind, that earlier the UN Committee on Human Rights has found violations of the rights of Belarusian citizens to freedom of association in cases of liquidation of the NGO “Civil Initiatives” (Homiel) and the RNGO “Human Rights Center “Viasna”, as well as the refusal of registration of NGO “Helsinki XXI” (Minsk), the NGO “For Fair Elections” (Minsk) and the NGO “Civil Alternative” (Homiel).
