Head of Non-governmental Organizations Department of Ministry of Justice Alena Kiryczenka considers that Optional Protocol to International Covenant on Civil and Political Rights doesn’t put legal duties to perform decisions of Human Rights Committee on the state.

This was reported to the founders of non-governmental organization “For Free Elections” by Ministry of Justice.

We remind that in regards with the decision that was taken by Human Rights Committee and according to which Belarusian authorities are obliged to reconsider the registration application of non-governmental organization “For Free Elections” Siarhiej Kaliakin and Viktar Karneenka appealed to Minister of Justice with claim to reopen the case on refusal to register of non-governmental organization established upon delivery of new facts

Officials of the Ministry of Justice confirmed one more time that authorities are not intended to move forward enforcement and defense of rights and freedoms of citizens.  

Human rights defender Leanid Sudalenka who represented founders of non-governmental organization “For Free Elections” in Human Rights Committee believes that no one and nothing can exonerate Belarus from responsible and scrupulous performing of decisions taken by Human Rights Committee.

 “Such statements of officials make rights guaranteed to every Belarusian citizen by article 61 of the Constitution, in accordance with which we have right to defend our rights and freedoms on international level senseless. By refusing to perform decisions of Human Rights Committee officials refuse to acknowledge our constitutional rights and freedoms on behalf of the state”, – human rights defender pointed out.

It must be noted that Republic of Belarus ratified Optional Protocol to International Covenant on Civil and Political Rights and recognized power of Human Rights Committee to investigate claims of Belarusian citizens by that. For the moment the country has to perform 77 decisions of Human Rights Committee and about 100 Belarusian claims are there under consideration.
