Gomel rights activist Leanid Sudalenka addressed to the head of the DSAI DIA of Homel region Executive Committee Ihar Makushenka with a complaint against the decision on an administrative case.

According to human rights activist, on September 17 his car was stopped by the traffic police officer who did not present himself and submitted a complaint about the car’s rear window tinting.

“The inspector offered to pay a fine of one base unit, otherwise, he said, he would make a protocol I would have to pay a fine of two basic units on administrative commission. The working day was over, I need to take my child from the kindergarten, so I had to pay a fine right there. By the way, one can not read the post and the name of the inspector on the receipt,” – commented Leanid Sudalenka.

“The officer did not explain the grounds on which he had come to the conclusion that the degree of luminous transmission of the car’s rear window was less than 70 percent. I conclude that it was determined on the basis of a subjective opinion of the traffic police officer, “- says human rights activist.

“According to the latest changes in the administrative law traffic police officer was supposed to apply the lower limit of the fine in my case – not more than five basic units. By the way, the maximum penalty for this article was not two, as the inspector was “frightening” me, but one basic unit. The traffic police officer has lied to me, or he just did not know the latest changes in the law, “- said the lawyer.

L. Sudalenka requests to teach the personnel of the DSAI of Department of Internal Affairs of Homel region Executive Committee the latest changes and additions to the administrative legislation introduced by the Law of the Republic of Belarus of July 12, 2013 under number 64 -3. He also asks to cancel the decision of the penalty and to oblige the traffic police officers to present themselves to drivers and fill out the data on the documents legibly.
