Homiel Regional Prosecutor’s Office investigator for the Central District Siarhey Kuzmiankou denied human rights activist Anatol Paplavny to initiate a criminal proceeding against the judge of the Central District Court of Gomel Alena Tsalkova. Junior counselor of justice considered that the judge who refused to give explanations, had no intention of imposition of unjust judicial act knowingly.

Let’s remind you that Mr. Poplauny previously addressed the Prosecutor General of Belarus with a request to initiate criminal proceedings against the judge of the Central District Alena Tsalkova. The Prosecutor’s General Office redirected the appeal of the human rights defender to Homiel Regional prosecutor’s office, then to the Central District Prosecutor’s Office.

Human rights activist says that the judge Tsalkova made a knowingly unjust decision on his administrative detention, and it completely fits Part 1 of Article 392 of the Penal Code, which foresees the responsibility of a judge for the misuse of the law.

“Today I filed a complaint to the prosecutor of Homiel region, because I consider the decision of the district prosecutor to be superficial and formal. If you do not have the authority to make the judge explain so write about it. How can we assume that the judge had no intent to do deliberately unfair decisions, even if she refused to say anything to the prosecutor? “- Human rights activist is puzzled.

I should add that after refusing the decision of Judge A. Tsalkova against A. Paplauny by Homiel Regional Court, a new protocol has been drawn up against him. On September 20, against human rights activist the case of “hooliganism” for which he served 15 days of administrative arrest have been re-examined. Judge Marina Damnenka confirmed the judgment of her colleague.
