Zhodzina human rights activists, Aliaksiey Lapitsky and Sviatlana Lapitskaya, claimed a picket in defense of Ales Bialiatsky on 08/22/2011. According to the current legislation, they sent the request to the Executive Committee on 08/07/2011, 15 days before the scheduled date of the event. The picket was supposed to inform Zhodzina citizens about the arrest of the well-known human rights activist Ales Bialiatsky which happened in Minsk.

For holding a picket the applicants asked for a specifically allocated platform approved by the town authorities. It was the platform near the entrance to the town park of culture, in front of the store “Euroset”.

Using their constitutional civil right to peaceful assembly, freedom of expression and dissemination of information, they hope to get permission to conduct informational picketing from 18-00 to 19-30 and wait law enforcement agencies to assist in maintaining public order in this area.

We remind you that after the change of leadership in Zhodzina executive committee, it is now headed by Mikhal Amielyanchuk. The citizens applied for a picket for the first time after the changes. The chairman of the executive committee decides whether to permit the event or not.

Aliaksiey Lapitsky: “So far, the whole past experience shows that partisan bureaucrats, “completely politicized vertical officials”, fixed on ideological expediency, despite the Constitution, as well as the International Covenant on Civil and Political Rights (mandatory for all the legal subjects in Belarus), instead of providing guaranteed rights, they continue to restrict them totally”.

– They are absolutely wrong to prohibit any public alternative in town under the artificial, false pretenses. Law enforcement and judicial appeals of citizens on this occasion are bogging in the quicksand of a real outrage controlled by the ideological department of the executive committee…

However, we should also take into account that the declared picket in support of the arrested Ales Bialiatsky organized in the framework of the law “On mass action …” is both a constitutional and legal possibility, and also a human rights need to implement procedures under the Belarusian CPC necessary to change the measure of restraint of the convicted.

Indeed, in order that citizens are properly informed and, according to Art. 221 of the CPC could meaningfully file (or not file) personal surety for the release of Ales Bialiatsky to the prosecutor’s office, one can not restrict their rights to implement this procedural right through legitimate mechanisms of free assembly and proper informing of citizens.

The prohibition of such acts, in conditions of the state’s ideological monopoly of mass media and the political component in the process over the well-known human rights activist, would be an obvious obstacle in the implementation of both constitutional and procedural rights of citizens. The deliberate obstacle in realization of the right to effective protection of a victim from a repressive political pursuit in Belarus.
