Zhodzina executive committee prohibited picketing devoted to the International Human Rights Day and informing citizens about violations of public and political law in Zhodzina district!

The request of 25.11.2009 to organize a peaceful meeting was filed by human rights activists and members of HRC “Viasna” in Zhodzina – Aliaksiey Lapitsky and Sviatlana Lapitskaya.

It was also planned to hand out publications of law content and to collect signatures for defending rights of Belarusian-speaking people.

The reply #02-03/180/4-л under the date of 04.12.2009 was sent to the applicants by post only on 18.12.2009.

This prohibition was motivated by the fact that the “package of documents filed by the applicants fell short of law standards of the Republic of Belarus “About public events in the Republic of Belarus”.

Aliaksiey Lapitsky comments on the received prohibition:

It is worthwhile noting that for carrying out two pickets filed in the format of peaceful themes which are useful for developing law priority in the country no additional expenses, no cleaning of a territory are required… And when all formalities are observed, all frames such as place and time of the event, contacts and names of the applicants-organizers are defined, the reason for prohibiting peaceful picketing looks like an ignorant decision or a misunderstanding, a mistake or a purposeful abasement of human dignity, an offence.

Human rights defenders from all over the world celebrate together December 10 as a significant event and a real holiday without any obstacles. Again they remind about adopting the Universal Declaration of Human Rights, about legal foundation on which Fundamental Laws and legal systems of democratic countries and International legal standards in the field of fundamental and indispensable human rights and freedoms are based.

But there mustn’t be ignorant officials at the helm of state. There also mustn’t be recidivist trespassers who, instead of performing their official duties for the citizens of the country, feel themselves like lords and slave-drivers who look after oppressed slaves, frightened and separated crowd-people. And people turn into crowd-people when there’s not a society, but a Gulag there. And this happens in states where fundamental laws and legal guides and priorities are lawlessly and un-constitutionally changed in principle.

Instead of PUBLIC AND POLITICAL RIGHTS, RIGHTS OF A CITIZEN there appears and is treated as a keystone of a society a COMMANDING CLAN OF SLAVE-DRIVER OFFICIALS, their wickedly outsized powers and total irresponsibility for breaking the fundamental law and for suppressing any public initiative and activeness.

In the situation when officials don’t bear any responsibility even for the grossest violation of civil rights and freedoms and are moved during taking lawless and discrimination decisions by a light corporative-ideological tactic, you can’t count on anything good.

Unfortunately the ruling power which can’t even be called legal, democratic and Belarusian didn’t carry out and isn’t going to carry out now its own constitutional and international obligations on guaranteeing the world-wide acknowledged public rights and freedoms in the country.

In the situation when no Belarusian official underwent any punishment for violations in this sphere, there is no hope for relief.

Vice versa, we can observe worsening of the situation with Human Rights in Zhodzina and in the whole country, systematic purposeful ignoring of law, widening of discrimination pressure upon Belarusian-speaking community on the basis of language, nationality and politics.

In connection with groundless prohibition of holding peaceful picketing in Zhodzina on 10.12.2009, devoted to the International Human Rights Day we’ll have to abandon the officially declared picketing prohibited by the authorities not to complicate the situation and not to provoke political repressions towards activists of civil society and human rights defenders in Zhodzina (exercised by authorities in any case).

But, surely, in private capacity everybody can take to the streets, to institutions of the town to distribute correspondent information and also to start collecting signatures about questions of defending state status of Belarusian language, Belarusian-speaking education in town schools, formatting street signs and demand guaranteeing Constitutional rights and freedoms referring to Belarusian-speaking citizens of Zhodzina.
Fortunately, this activity doesn’t require any advance inquires and permissions-prohibitions from the officials of nowadays ruling regime. And the lawless prohibition of peaceful events in Zhodzina will be challenged in a juridical procedure and, if necessary, its lawlessness will be reviewed at the Human Rights Committee of UNO in Geneva.

Moreover let’s draw your attention to the fact that such activity is already taking place. After the answer from the Supreme Court the Republic of Belarus, an individual appeal to HRC of UNO will be filed, in which Aliaksiey Lapitsky and Sviatlana Lapitskaya bring up questions about non-correspondence of positions of the Law “About mass events in the Republic of Belarus” and their realization in practice which totally contradicts legal standards and demands of International Covenant about public and political law.

Random and proper use of this document in discrimination goals let officials of local executive committees use boundless powers and violate indispensable rights and freedoms of citizens and stay unpunished upon their ideological opinions or corporation-clan interests which are far from the meaning and demands of law.

And we would like to warn people who will take to the streets of Zhodzina on this special day, – “Don’t gather more than three!!!”
As the experience shows the present regime can observe a meeting of more than three people as a mass event or demonstration carried out without an advance agreement and permission of authorities. And if together with this you will talk and express your views –different from the only officially right position, you can be accused of non-sanctioned meeting, which is very complicated to challenge in courts subordinate to the “vertical”. In this case everyone of you risk to get prisoned for several days or (which is getting more often lately, in connection with crisis) to pay the administrative fine in the amount of 700 thousands rubles.
SO, DEAR ZHODZINA CITIZENS, HAVE AN EYE IN YOUR HEADS during International Human Rights Day! Be aware of who you deal with but don’t forget about YOUR OWN CONSTITUTIONAL RIGHTS AND FREEDOMS. FIGHT FOR THEM, FOR YOURSELVES, FOR YOUR CHILDREN AND FREE DEMOCRATIC BELARUS…WILL BE FOR SURE. AND WE ALL WILL SUCCEED! BUDZMA!!!
